Terms of Use

1. Information only, not an engineering opinion

The content of the Site, including service descriptions, frequently asked questions and general statements about engineering, building codes, insurance or legal processes, is general information provided for educational purposes. It is not an engineering opinion, inspection, report or recommendation about any particular property or loss, and it should not be relied on as one.

Engineering opinions about a specific property or loss are formed only after examination of the available physical evidence, are stated to a reasonable degree of engineering certainty, and are provided only under a written engagement.

Nothing on the Site is legal advice, an insurance coverage determination, or an appraisal or adjustment of an insurance claim. We do not prepare, negotiate, adjust or settle insurance claims on behalf of any party. General information about Florida laws, deadlines and building codes may change; confirm the current requirements with your insurer or attorney.

2. No professional relationship without a written agreement

Using the Site, submitting the contact form, or emailing or calling us does not create an engineer-client relationship, a professional engineering engagement or any duty of confidentiality. An engagement begins only upon a written agreement signed by both you and Elemental Forensic Services.

Before accepting any matter, we must complete a conflict-of-interest check, and we may decline any engagement.

3. No promised outcome

Every loss is different. Findings are based on the physical evidence and accepted engineering principles, and they are reported the same way regardless of who retains us. We do not promise or predict the outcome of any claim, dispute or case, and nothing on the Site is a warranty of any result.

4. Intellectual property

The Site and its content, including text, graphics, the Elemental Forensic Services name and mark, and the design of the Site, belong to Elemental Forensic Services LLC or its licensors and are protected by intellectual property laws.

You may view, download and print pages for your own personal use or to evaluate our services. You may not copy, republish, modify or distribute Site content, or use our name or mark, without our written permission, except as the law allows.

5. Acceptable use

Please use the Site lawfully. You agree not to:

• interfere with the Site’s operation or security, or try to gain unauthorized access to it;
• send spam or automated submissions through the contact form;
• submit false information, or information you do not have the right to share.

6. Links to third-party websites

The Site may link to websites operated by others, such as government agencies, licensing boards and service providers. These links are provided for convenience. We do not control those websites and are not responsible for their content, availability or privacy practices, and a link is not an endorsement.

7. Disclaimer of warranties

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Site will be uninterrupted or free of errors.

We try to keep the content accurate and current, but it may contain errors or become outdated, and we may change or remove it at any time.

8. Limitation of liability

To the fullest extent permitted by law, Elemental Forensic Services will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of the Site or your reliance on its general information.

This section does not limit any liability that cannot be limited under applicable law. Professional engineering services are governed by the written engagement agreement for those services, not by these Terms.

9. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the jurisdiction of those courts.

10. Privacy

Our Privacy Policy explains how we collect and use information through the Site.

11. Changes to these Terms

We may update these Terms from time to time. Updated Terms take effect when they are posted on this page with a new effective date. If you continue to use the Site after that, you accept the updated Terms.

12. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. If you engage us, the written engagement agreement controls over these Terms for the services it covers.
